Terms of Service

1. Who you are contracting with

frankeApply is operated by Franke Personal ("we", "us"). By creating an account or using the service you enter a contract with Franke Personal and agree to these Terms and to our Privacy Policy. You confirm you are of legal age and, if acting for an organisation, that you have authority to bind it.

2. The service & AI features

frankeApply provides tools to track job applications, translate/optimize résumés, and generate cover letters. We use advanced artificial intelligence, including Google Gemini and open-source models from Mistral AI, to power our AI-assisted features.Use of these AI features is completely voluntary; they will only process your documents and descriptions if you explicitly agree to use them by invoking the feature (such as clicking "Generate Cover Letter", "Translate CV", or "Analyze Your CV").

Uploading or inputting a CV/résumé is entirely optional, and you have the sole right to decide whether to save your CV on the platform.

For ATS score checking features, frankeApply does not save or store your uploaded résumé or cover letter on the system database or server files. The content is processed ephemerally in memory to calculate your score. Once you navigate away from the page, switch tabs, or close the session, the uploaded files will automatically disappear from memory and cannot be recovered.

We do not guarantee uninterrupted or error-free operation, nor do we guarantee any employment outcome. Outputs from AI features may contain inaccuracies; you are solely responsible for reviewing and verifying them before use.

3. Acceptable use

• No unlawful use, fraud, spam, or infringement of others' intellectual property.
• No bulk or unsolicited commercial messaging through the platform (see § 7 UWG).
• No probing, scanning, scraping, reverse-engineering, or interference with the security or integrity of the service.
• You are responsible for the accuracy of the personal data and résumés you upload, and for keeping your account credentials confidential.
• Outreach emails are only sent after your explicit, manual confirmation.

4. Intellectual property

Franke Personal retains all rights, title and interest in the frankeApply service, including its software, design, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service for your personal job-search purposes under your active plan. You retain ownership of the content you upload (résumés, cover-letter drafts, application data) and grant us a limited licence to host and process it solely to provide the service. You must have the rights to any content you upload.

5. Payments & Invoicing

Payments for premium subscriptions are processed securely via PayPal. By purchasing a subscription, you authorize PayPal to charge the designated payment method for the recurring fee. PayPal handles billing, transaction history, and cancellations under their billing policies.

Premium subscriptions renew automatically each billing period until cancelled. You can cancel any time from Settings or directly in your PayPal account settings; cancellation stops future renewals and your access continues until the end of the current paid period.

6. Subscriptions & Digital Access

Due to the immediate digital availability and AI generation resources provided upon subscription, all purchases are final and non-refundable unless required by applicable mandatory law. Subscriptions can be cancelled at any time to prevent future billing cycles.

7. Suspension & termination

We may suspend or terminate access in case of material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may delete your account at any time; upon deletion all your data is purged irreversibly, subject to retention periods required by law (see Privacy Policy § 7).

8. Warranties & liability

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement) and our aggregate liability is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special or incidental damages (including loss of profits, data, or goodwill). Nothing in these Terms limits liability that cannot be limited by law (e.g. for fraud, death, or personal injury). Statutory consumer rights remain unaffected.

9. Governing law

These Terms are governed by the laws of the Federal Republic of Germany.
